Thomas T Treadway To C. W. Sturdivant
This Indenture made this 4th day of Sept. AD 1855 Between Thomas T Treadway of the first part and C W Sturdivant of the second part and W P Kendall of the third part all of the County of Anson and State of North Carolina witnesseth that whereas the said Thos T Treadaway is Justly indebted to the said W P Kendall in the sum of one hundred dollars Book Act. and also to William Sturdivant in the sum of thirty dollars due by act. also fifteen dollars as security to a note due Calvin J Lilly, also to Kindall & Lilly by Judgment for fifty 92/100 dollars due 17th March 1854 also one other Judgement to Kindall & Lilly for fifty 92/100 dollars due 17th March 1854 also one other Judgement due Kindall & Lilly for sixty five dollars due 14 March 1854 and the said Thomas T Treadaway being anxious to indemnify the said P Kindall, W Sturdivant & Kindall & Lilly against any less which might accrue therefore in consideration of the premises & the further sum of five dollars to me in hand paid by the said C W Sturdivant the receipt whereof is hereby fully acknowledged The said Thomas T Treadaway hath bargained sold and by these presents doth bargain Sell assign & convey to the said C W Sturdivant all of his present growing crop

of corn fodder shucks hay wheat oats & Cotton Pleas? and potatoes To have and to hold all singular the above described growing crop together with all the privileges and appurtenances thereunto belonging or in anywise appertaining to him the said C W Sturdivant his heirs Executors and administrators in trust for the following use and purposes and no other that is to say that if the above named debts owing by said Treadaway are not fully paid off and satisfied by the said Treadaway on or before the first day of Jany 1856 then and in that case it shall be lawful and shall be the duty of the said C W Sturdivant being thereunto Registered by the said Kindall to take into his possession and sell at public auction for cash the property above mentioned after advertising the same at the Court house in Wadesboro and two other public places in the County for the space of twenty days and out of the proceeds of said sale after retaining the necessary Expenses of this trust to pay off and satisfy the above named debts and surplus of said sale if any may still be remaining in his hands he shall pay over the same to the said Thomas T Treadaway or his assigns an it is further agreed between the parties that all the above described property shall remain in the possession of said Treadway until such time as it may become necessary for the said C W Sturdivant to take possession thereoff (sp) for the purpose of this trust and the said Thomas T Treadaway doth covenant and agree for himself and heirs with said C W Sturdivant that he is lawfully seized of the aforesaid crops and it is also agreed that if the above named debs and Interest shall be paid by the said Treadaway without the sale of the property herein conveyed then the Title thereunto shall revert in said T T Treadaway without a formal conveyance from the said C W Sturdivant.

County Court Clerks office September 4th 1855 Then the foregoing Deed of Trust from Thomas T Treadaway to C W Sturdivant was duly proven before me by the oath of B D Kindall a subscribing witness thereto and ordered to be registered
