     Clerks office June 10, 1839. Be it remembered that on this day to in vacation of the Probate Court of said County the last will and Testament of John Treadway deceased was produced and presented to me Isaac J. Boardman Clerk of said Court by John Treadway and Washington Treadway the Executors therein named for Probate which said will now duly proven according to law by the oaths of Edward Carvin, John Lewis, and Thomas Hartman the subscribing witnesses thereto which said will and proof are recorded in the words and figures following to wit. Last Will and Testament of John Treadway. I John Treadway of the County of Bartholomew and State of Indiana being now of sound mind and memory and in the sixty eighth year of my age calling to mind the mortality of my body knowing that I with all mankind have to die do constitute and ordain this my last will and Testament as follows:

     1st: My will and desires that all my just debts be paid and that my funeral expenses be plain and moderate.

     2nd: That whereas I have heretofore made advances in property to all my married children viz: Griffin Treadway, John Treadway, Jr, Mary Belle (Bills), Martha Riadon (now dead) Richard Treadway, Washington Treadway, James Treadway, Stephen Treadway, Elizabeth Vanmeter, Rhoda Reid, and Newton Treadway. My desire now is that my two remaining and youngest sons Franklin Treadway and Milton Treadway be made equal in property to the advances heretofore made to the others, viz: To each a horse saddle and bridle of common quality, one cow and calf, one bed and bedding, four sheep and four hogs, when they or either of them to the age of twenty one years or get married.

     3rd: That the residue of all my estate both real and personal, I bequeath to my beloved wife Elizabeth Treadway during her natural life or widowhood should she survive my self but in case she be married again she is only to retain one third part during her life and at the death or marriage of my widow Franklin Treadway and Milton Treadway to have five hundred dollars each and that residue of my estate be sold and equally divided between all of my aforesaid children except Washington Treadway who has heretofore who has received his equalised full shear and except my deceased daughter Martha Riadon who has left four children each of which children of Martha Riadon are have one dollar each in full for their portions of my estate having heretofore to have.

     4th: My further desire is that there be no inventory or appraisement of my estate until after the death of my wife but that the whole personal property be at the controle of my wife and executors to be applied to the maintenance and comfort of her my said wife without waste or unnecessary extravagance.

     5th and Lastly: I hereby constitute ordain and appoint my two sons John Treadway and Washington Treadway executors of this my last will and Testament or any one of them which may survive me. In testimony whereof I have here unto set my hand and affixed my seal this 22nd day of August in the year of our Lord one thousand Eight hundred and thirty six.
