Indenture between William Treadway and Francis Bird – 20 February 1796

This indenture made the 20th of February in the Year 1796 Between William Tredaway of the County of Sullivan and State of North Carolina and Francis Bird of the County of Hawkins and State aforesaid Witnesseth that for and in Consideration of the sum of fifty pounds Virginia Currancy paid to the said Treadway by the Sd Bird the Receipt Whereof he doth hereby acknowledge the Sd William Tredaway hath Bargained, Granted, and Sold. aliened, and confirmed by those Presents doth Bargain, Grant, Confirm to the Bird his heirs and assigns a Certain tract or parcel of land lying on the north side of Holston River Beginning at a lime tree on the Bank and Bounded on the west by Charles Ison and Running for Sd line along a per__ line thence North 18 deg. West 100 poles to a small poplar on the Virginia line Thence along Sd line East 37 poles to a Stake from thence South 80 poles to the River thence down the River as it manders to the Containing 150 acres of land more or less with all Wood profits, and advantages, hereditaments, and appurtenances whatsoever to the sd tract or parcel above mentioned or in any wise appertaining thereunto also all the Right Title, Interest, Claim or demand Whatsoever the Sd Wm. Tredaway Shall have to the Sd Tract of Land and Every part Thereof to have and to hold the 150 acres of land sale the appurtenances thereunto Belonging to the Sd Bird his heirs and assigns to the one use and Behoof of him the Sd Francis Bird his heirs adms. and assigns forever. The Sd William Tredaway doth By these presents Binds myself my heirs and assigns to warrant and defend the Sd Tract of land against a person or persons to the Sd Bird forever and Every part thereof to the Sd Bird his heirs and assigns in testimony whereof to I have set my hand the day and date above within.

State of Tennessee Washington County on the 14th Day of March 1803 Personally Came John Woolf whose names Subscribed as a witness to the within indenture Before me David Campbell one of the Judges Superior Courts of Law and Equity and for the State of Tennessee who being Duly Sworn Deposeth and Sayeth that he was present and Saw William Treadway the Within named Signs Seal and as his act and deed Deliver the within indenture for the use and purpose therein Expresed and that at the Request of the partys at the time of Execution he Subscribed the Same as a witness Sworn to and Subscribed the day and date above before me Let it be Registered.
