This indenture made the third (3) day of December in the year of our Lord (1859) Eighteen Hundred and fifty nine Between Robt. Teague and James F. Teague, John Cassidy and Sarah his wife of the County of Madison and State of North Carolina, Nathaniel Smelson and Ann his wife, John Tredaway and Nancy his wife of the County of Buncombe and State aforesaid of the one part. And A. Y Teague of the County of Madison of the State aforesaid of the open part. Witnesseth that the said first party for and in consideration of the sum of Four Hundred Dollars to them in hand paid by the said A. Y. Teague the receipt whereof is hereby acknowledged hath granted bargained and sold, aliened, and confirmed and by the presents doth give grant bargain and sell alien? and confirm with the said A. Y. Teague his heirs and assigns forever all that tract piece and parcel of land situated lying and being in the County of Madison on a small parcel of Sandy Mush, their creek on the North side and bounded as follows. Beginning on a large Spruce pine on the South bank of said creek at a cliff of rocks and where old Hall and Walton and McIntire’s old line crosses the same and runs North 70 poles to a black oak on said line thence West 250 poles crossing said creek to a Chestnut on a ridge then South 150 poles to a poplar and white oak then East 48 poles to a white oak on a hill side then South 4 of poles to a Hickory near a branch then East 192 poles to a stake the Hall and Walton line and with that line North to the beginning, containing 258 acres which said piece or parcel of land with all ways, woods, waters, mines, minerals and hired itancents? and offer laneses?.

The said R. Teague, J. F. Teague, J. C. Cassidy and wife, N. Smelson and wife J. Tredaway and wife doth warrant and defend from themselves their heirs, Executors, administrators and assigns and the said first part doth warrant from all claims into the said A. U. Teague but to his heirs, administrators, and assigns forever in testimony where of we have hereunto set our hands and seal the day and date above written.

This day personally appeared before me John L. Bailey one of the Judges of the Superior Court of Law and Equity for said State N. S. Nelson and Anna S. Nelson his wife and John Treadaway and Nancy Treadaway his wife and acknowledge the execution of the foregoing Deed and the said Nancy Treadaway and Ann Treadaway (think this should be Nelson) being by me privately examined separate and apart from them said husbands to change the execution there of do say that they and without any fear or comprehension whatever on the part of their said husbands. October the eighteenth Eighteen Hundred and fifty four (1854) Let the certificate be registered with ____.
