     In the name of the Lord God Amen I Joseph Hayward of the Towne of Concord in the County of Middlesex in the Provence of Massachusetts Bay in New England yeoman Being of sound good perfect Memory praise be given to God for the Same Yet Knowing the certainty of the Life on Earth and Being Willing to settle things in order do make and ordain this to be my Last Will and Testament Hereby Revoking all former Wills by me made and signed to be Null and none Effect:

     In Primis: My soule I give into the hands of all mighty God that gave it in sure and certaine Hopes of Eternal Life through our alone Lord and Saviour Jesus Christ & my body to the Earth from whence it came to be deceantly Interred at the Discretion of my Executors hereafter named and after my funerall Expenses and Debts Satisfied and paid what worldly goods it hat pleased God to Endow me with All I do give and bequeath in manner and form as followeth ~~~

     Item: I give and Bequeath unto my Beloved Wife Elizabeth Hayward all my moveable Estate of all sorts and kinds whatsoever; Excepting one gunn one sword one pair of pistols and holsters and one pair of Andiorns (Andirons?) and one Bed and Bolster and one parlor plattor: also the bed stand belonging to the Bed aforesaid, all the Rest of the moveable Estate I do her and Her Heirs for ever only to be disposed of as shall so cause amongst my Children also. I do Loane all my Real Estate with my wife Elisabeth to Improve for her & Benefit during the time of her Widowhood and to make sale of any part of the land if she shod stand in now thereof for her Comfortable subsistance.~~~

     Item: I do give and Bequeath unto my daughter Mary Whitcomb the gunn and sword pistols and holsters and Andions (Andirons?) and Bed and Bolster and bed stand and plattor for her to dispose amongst her Children as shee shall so cause amongst and as to the Reale Estate which shall be left after my will of D_____ my will is that it shall be equally Divided amongst all my children sons and Daughters taking in my Daughter Mary with the Rest: Also my will is that the Children of my son Ebenezer Hayward shall have that part which might have fell on to their fathers share of my Estate. Hereby Authorizing and fully Impowering my fine sons Simson Hayward and David Whitcombe to be whole and sole Executors Joyntly and S__drally of this my Last will and testament.

     In Witness whereof I the sd. Joseph Hayward have hereunto set my hand and seal the twentieth and ninth day of January Annodomini one thousand seven hundred and Eleven alias Twelve and in the tenth year of her Majesties Reign over England
