     This Indenture Made and entered into this day above written between Malinda Treadway and James Treadway of Madison County N.C of the first part and John F Ponder of the Same County and State of the Second part.  Witnesseth: that for and in Consideration of the sum of one hundred and thirty dollars to them the Said Malinda and James Treadway aforesaid by the aforesaid John F Ponder all the lands upon which the Said Malinda Treadway now lives which lands are bonded by lands of John Radford W. C. Ammons T S Deaver and the lands belonging to the heirs of E Jervis Decd,  To Have and to Hold to the Said John Ponder his heirs and assigns forever  But upon this Special trust that if the Said Matilda and James Treadway pays or Causes to be paid to the Said John F Ponder one hundred and thirty dollars for which he holds the note of the Said James Treadway due March 1st 1887 hen this Mortgage and intent to be null and void but if the said Matilda Treadway and James Treadway fails to pay Said note of one hundred and thirty dollars by the first day of March 1887 then the said John F Pounder May sell said land or so much of it as is Necessary to pay the above named note and all Costs, Said Sale to be at public auction to the hig in the presents of the highest bidder for __dy cash.
