I, Jim Treadway, of R. F. D. #1, Elizabethton, Tennessee, being of sound mind and memory, do hereby declare, make and publish this as my Last Will and Testament, hereby revoking and canceling any and all wills by me anytime heretofore made.
First, I direct that all my just debts be paid out of my estate in accordance with proper proof and as required by law as soon after my death as possible, and I further direct that my body be given a decent and just burial in keeping with my station in life, and that I hereby appoint Arthur Treadway as the executor of my Last Will and Testament, to carry out my wishes as contained herein and that he qualify as required by law.
Second, I therefore, herewith, direct that all cash, stocks and bonds, and securities of which I may die seized and possessed wherever located be divided into three parts equally as follows to wit: (a) One third to my beloved son, Arthur Treadway, to be his own absolutely and forever. (b) One third to my beloved son, Robert Treadway, to be his own absolutely forever. (c) The balance or the remaining one third of my estate I direct to be given and go to Jo Anne Hathaway, my granddaughter, the child of my beloved daughter, Claris Treadway Hathaway. I further direct that my Executor make proper and safe arrangements for said sum to be held in Trust through the Carter County Bank to be delivered to her when she has reached her 21st birthday, and I further direct that it may not be used by her or anyone else and that no one be allowed to qualify as Guardian to take said money from said Bank until she is 21 years of age, unless it is for serious sickness on her part and to be approved by proper Court only.
Third, I further give and bequeath to my beloved daughter Claris Treadway Hathaway the sum of $5.00 out of my estate to be paid by my Executor.
